Glossary
Comparative fault
Definition
The principle that a plaintiff's own share of responsibility for an injury reduces recovery rather than necessarily barring it.
Where it varies
New York applies pure comparative fault, so recovery is reduced by the plaintiff's percentage without a cutoff.
