Implied consent

Definition

The rule that holding a driver's license constitutes advance agreement to chemical testing for intoxication once an officer has made a lawful arrest. Refusing that test triggers license consequences separate from the criminal case.

Where it varies

Varies by state. In California a first refusal carries an automatic one-year suspension; in New York, revocation of at least one year plus a civil penalty.
