In the Matter of the Marriage of Claire Noel Callahan and Matthew John Lewis and in the Interest of A.C.C., a Child v. the State of Texas

The court of appeals affirmed the trial court’s decision to change the child’s last name to Lewis, rejecting the mother’s choice to give the child the surname Callahan without the father’s input. The appellate court also upheld the custody arrangement, overruling the mother’s objection that the possession schedule should align with her older child’s. Because these rulings were affirmed, the court determined the condition for the conditional award of $45,000 in appellate attorney’s fees to the mother was not triggered.

Newton v. LVMH Moët Hennessy Louis Vuitton Inc.

Andowah Newton appeals the dismissal of her retaliation lawsuit alleging she was fired after reporting sexual harassment, arguing that the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act invalidates an otherwise binding arbitration agreement. The Second Circuit reversed the district court's decision to dismiss her initial complaint, determining that she plausibly alleged engaging in protected activity by refusing to meet with her supervisor to settle arbitration claims. The court, however, affirmed the denial of her request to amend her complaint, holding that the claims she sought to add accrued prior to the statute's effective date and did not reaccrue.

Employment

DiFronzo v. City of Somerville

A federal appeals court reversed a judgment in a Massachusetts employment dispute involving a police officer who challenged a termination after he had already been reinstated through arbitration. The court determined that the trial judge improperly permitted the plaintiff to present evidence regarding a decision to place him on paid administrative leave—a motive not alleged in the complaint—as a basis for damages. Consequently, the ruling applies only to the portion of the judgment awarding damages based on the paid leave decision.

In re: estate of Miller

This case arose from a will contest where Michelle Zwerling challenged a will left by her uncle that named Patricia Kahn as executor, arguing it was a forgery and the product of undue influence. The trial court admitted the will to probate and, after a full trial, upheld its validity. The appellate court affirmed that decision, ruling that the trial court’s admission of the will was a substantial ruling and that the motion to substitute the judge was untimely.

Ultimately, the court sustained the entry of the divorce decree and custody award.

After a bench trial where the State's sole witness testified that Cheatham abandoned the device upon absconding, the municipal court convicted him.
