Plaintiff Jessica Bergin sued her employer after being terminated for failing to comply with a COVID-19 vaccination requirement after her religious exemption request was denied. The Second Circuit vacated the district court’s summary judgment in her favor, ruling that the court failed to apply the correct Supreme Court standard for religious accommodation claims and improperly treated portions of the discovery record as judicial admissions. The appellate court remanded the case for further proceedings.

Elijah Kerry Garrison v. Commonwealth of Virginia
The Court of Appeals of Virginia affirmed the denial of a motion to suppress a firearm discovered during a Terry frisk, concluding that officers had reasonable suspicion to believe defendant Elijah Kerry Garrison was armed and dangerous based on the totality of the circumstances. Factors supporting this ruling included the timing of the stop in a high-crime area, Garrison’s evasive actions such as rolling windows and putting on a sweatshirt, his nervous response to inquiries about weapons, and his physical movements obscuring his waistband.

Park At Autumn Ridge BD TIC LLC v. Tesha Hill-McDonald
Tesha Hill-McDonald sued the operator of an apartment complex for injuries sustained after falling on its steps, resulting in a default judgment. The Mississippi Court of Appeals, however, reversed those rulings, set aside the default judgment against Park, and remanded the case for further proceedings.

Meehan v. Aguirre
The Court of Appeal affirmed a trial court's order granting a motion to tax costs in a personal injury case where the plaintiff sought expert witness fees and prejudgment interest. The appellate court ruled that the plaintiff was not entitled to the sought-after fees and interest because her recovery did not exceed her final $2 million Section 998 offer. Additionally, the court upheld the trial court’s tax on costs for trial transcripts, a "Day in the Life" video, and trial technician services due to a lack of evidence regarding their necessity.

State of Idaho v. Braden Philip Lane
Braden Philip Lane appealed his conviction for felony excessive DUI, arguing the jury was improperly instructed regarding the required blood alcohol concentration and that the state failed to sufficiently prove his identity for the sentencing enhancement. The State conceded that the district court committed fundamental error by instructing the jury that Lane could be found guilty without finding he had a BAC of 0.20 or more. Consequently, the judgment of conviction for the excessive DUI and the sentencing enhancement were reversed and the case remanded.

Utz v. Utz
Lorraine A. Utz appealed the trial court’s denial of postdissolution motions regarding a home equity line of credit and interest payments. The Appellate Court reversed part of the judgment, determining that the 2017 and 2019 agreements made by the parties did not extinguish the defendant’s obligation to close the credit line. The court upheld the trial court's decision to deny interest on the UGMA accounts and concluded that the plaintiff's argument regarding the defendant's credibility was inadequately briefed.

James v. Lexington Health Care Center of Chicago Ridge, Inc.
Cecilia James appeals summary judgment in a wrongful death action, asserting that Lionel James equitably adopted Jeremy Overstreet to establish him as the statutory "next of kin." The Illinois appellate court affirmed the trial court, ruling that equitable adoption—recognized in Illinois only as a probate remedy—does not create the legal relationship necessary to qualify as "next of kin" under the Wrongful Death Act.

The Supreme Court of Colorado held that a district court’s dismissal of a dependency and neglect petition was a final, appealable order because it effectively ended the action and determined the parties’ rights. The court reversed the Court of Appeals' decision, concluding that the temporary custody order adverse to the father effectively became permanent upon the petition’s dismissal, leaving nothing further for the court to do.

Richardson v. National Railroad Passenger Corporation
Shaunta Richardson sued Amtrak alleging race discrimination and retaliation under Title VII and the District of Columbia Human Rights Act after she was terminated as a police officer in 2024. Amtrak defended the firing by pointing to two misconduct incidents, including one in which Richardson repeatedly struck a customer seated in a wheelchair. Because the court found that no reasonable jury could conclude that the non-discriminatory reasons for termination were pretextual, it granted summary judgment to Amtrak.

State v. Efford
Linda Efford appealed the trial court’s imposition of consecutive prison terms for attempted assault and a felony OVI, arguing the judge failed to make the requisite findings under Ohio law to justify consecutive sentences. The trial court cited Efford’s substantial prior criminal record and history of alcohol-related offenses during the sentencing hearing. The appellate court affirmed the judgment, finding that the trial court’s findings regarding the necessity of consecutive sentences were supported by the record and incorporated into the judgment entry.

Butler appealed his conviction after pleading guilty to a felony failure-to-comply charge, arguing the trial court erred in accepting his guilty plea before referring him for an intervention in lieu of conviction assessment and that his offense was ineligible for the program. The appellate court affirmed the judgment, concluding the trial court did not err in accepting the plea and noting that because the court had not entered a specific judgment regarding eligibility and Butler withdrew his request for ILC, the issue was moot.

United States v. Jackson
The case involves a defendant's appeal of a conviction for unlawfully possessing a firearm based on a gun found during a police pat-down, which the defendant argued lacked reasonable suspicion to justify the stop. The appellate court agreed with the district court's decision that the circumstances, such as the defendant's furtive movements and other people standing near the SUV, provided a lawful basis for the detention. The court further found no clear error in the district court's factual findings regarding these observations.

A father filed a petition for care and protection of his son from alleged abuse by the mother, but a Juvenile Court judge dismissed the case, citing an ongoing parentage dispute in Probate Court as the reason. The Appeals Court vacated the dismissal, concluding that the governing statute establishes a distinct action in the Juvenile Court different from those available in Probate Court.
