Cook v. Noel
The appellate court reviewed a wrongful death settlement case where the decedent’s mother sought to allocate the settlement proceeds between wrongful death and survival claims and determine the dependency of the heirs. The court vacated the lower court’s order, finding that the trial court abused its discretion by mishandling the procedural presentation of the case and failing to appoint a Guardian Ad Litem for the minor children. Consequently, the appellate panel sent the case back to the circuit court for a new hearing to properly address the allocation and dependency issues.

Terry Jenkins was convicted by a Morgan County jury of home invasion and related offenses stemming from a string of thefts, robberies, and assaults. He appealed the denial of the motion for new trial, arguing that the evidence was insufficient and that evidence obtained from his Facebook account should have been suppressed. The court affirmed Jenkins' conviction, determining that while the Facebook evidence was wrongly admitted, the error was harmless beyond a reasonable doubt and no other errors were demonstrated.

Marriage of Traweek
The Second Appellate District Court of California affirmed the trial court’s decision to dissolve the marriage and award spousal support to Candice Traweek, ruling that the judge did not err despite her conviction for domestic violence. The appellate court found that the trial judge did not misinterpret the applicable law nor abuse discretion in determining that Candice had successfully rebutted the presumption against her receiving support. Consequently, the appellate court sustained the trial court's judgment.

Tanuk S. v. Department of Family & Community Services, Office of Children's Services
The Supreme Court of Alaska examined whether a child’s attorney could prevent a Guardian ad Litem’s waiver of the psychotherapist-patient privilege in Child in Need of Aid proceedings. The court held that a child's objection does not nullify a GAL's waiver and that the child bears the burden of justifying protection rather than the attorney. Therefore, the court affirmed the trial court's decision to disclose the mental health records despite the earlier objection.

State v. Dennis

State v. McKim
David McKim appealed a conviction for operating a motor vehicle with a prohibited urine alcohol level after the trial court denied his motion to suppress, arguing the initial police encounter lacked reasonable suspicion. The appellate court affirmed the trial court's judgment regarding the suppression motion, concluding that the officers' response to an accident was a consensual community-caretaking function rather than a Fourth Amendment seizure. McKim remains bound by the trial court's sentence of sixty days in jail with suspended time and a $575 fine.

State v. Brown
Eric Brown appealed his guilty plea and conviction for carrying a concealed deadly weapon and illegal possession of fentanyl by filing a postconviction motion arguing that his plea counsel provided ineffective assistance. The Superior Court denied the motion, finding that the defendant waived his objections by failing to meet a timeline specified in court rules and failing to prove that he would have insisted on a trial but for his lawyer's advice.

Cheryl Walker v. Uber Technologies, Inc.
Cheryl Walker sued Uber Technologies, Inc. after an accident occurred during a guest ride, and the company moved to compel arbitration based on an arbitration agreement implicated by an unsolicited text message. The appellate court affirmed the district court’s decision, finding that the guest rider was not contractually bound to arbitrate because he never downloaded the app or created an account, did not see the text message, and thus entered into no agreement with Uber.

In re Matthew V.
An appellate court affirmed the trial court’s judgment terminating the parental rights of a biological father with respect to a minor child diagnosed with a rare genetic disorder and complex medical needs. The court rejected the father’s argument that the Department of Children and Families failed to make reasonable efforts to reunify the family, finding that his lack of training and absence from medical appointments justified the case's outcome. Ultimately, the appellate court determined by clear and convincing evidence that the father failed to rehabilitate to a degree sufficient to encourage the belief that he could resume parental responsibilities.
