Stevens, Owen v. Mila Brown

Owen Stevens appealed a Family Court order denying his motion to reargue ancillary divorce proceedings, arguing over the resulting asset division. The Supreme Court affirmed the decision to deny the motion, finding it untimely and unsupported by a showing of excusable neglect, while noting it lacked jurisdiction to review the asset division ruling due to procedural defects.

State v. Robert M. Christianson

State v. Robert M. Christianson addresses an appeal where the defendant argued that three prior OWI convictions must be excluded from counting toward his sentence because he was denied his constitutional right to counsel. The appellate court concluded that the State failed to prove a knowing, intelligent, and voluntary waiver of counsel in one of the three prior cases, rendering that conviction invalid for sentence enhancement. Accordingly, the court reversed the lower court’s judgment in part, remanded for resentencing with the offense treated as a seventh offense.

Mast v. A.A.

Joshua and Stephanie Mast adopted a wounded Afghan orphan in 2020, and A.A. and F.A. later attempted to vacate that adoption order based on claims of custody under Afghan law. While the circuit court and Court of Appeals held that Virginia law did not bar the challenge, the Supreme Court of Virginia reversed those decisions. The court ruled that Virginia Code § 63.2-1216 does apply, entering final judgment dismissing the petition to vacate the adoption.

Sarah Rock v. Dog Daze of Charleston, LLC

Sarah Rock appeals the circuit court’s order granting partial summary judgment in favor of Respondents following the death of her dog Xumi and injury to Ruben, specifically challenging a ruling that she cannot recover emotional distress damages for the harm to her animals. The Court of Appeals affirmed this decision, holding that because South Carolina classifies pets as personal property, emotional distress damages are unavailable under the traditional measure of recovery for animals. Additionally, the court declined to overrule precedent to allow such awards based on the companion status of dogs, stating that the issue is best resolved by the legislature even though some jurisdictions allow it for intentional acts that are not claimed here.

Jackson v. KA-3 Associates, LLC

This case involves a tenant suing his landlord under the Oregon Residential Landlord and Tenant Act for injuries related to a plastic light fixture cover that fell in a common hallway, while the Oregon Supreme Court previously held that habitability obligations extend to areas outside the dwelling unit. On remand, the Court of Appeals was tasked with deciding whether, under that expanded scope, the incident created a situation where a dwelling unit could be considered unhabitable, though the opinion text cuts off before resolving this specific issue.

Respondent Clyde C. Crane IV admitted to violating professional conduct rules by failing to comply with a divorce decree and disciplinary investigations, leading the appellate panel to agree that negotiated discipline was appropriate. The court ordered a thirty-day suspension stayed in favor of one year of unsupervised probation, subject to specific conditions including updating contact information and complying with spousal support obligations. If Crane fails to maintain his probation, the Office of Disciplinary Counsel may seek to revoke it, potentially resulting in the consecutive service of the suspension with any future discipline.
