In re Guardianship of K.S.

The Supreme Court of New Hampshire determined that the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act, rather than the state's traditional residency statutes, governs whether a New Hampshire court can exercise jurisdiction over an adult guardianship proceeding. The court found that K.S. lacked a "home state" in New Hampshire because she had been physically present in Maine continuously since 2019, a duration that satisfied the statutory six-month physical presence requirement. Consequently, the trial court lacked jurisdiction over the case, and the appointment of the guardian was vacated with instructions for dismissal.

Scott Drewry sued the Town of Greybull and Chief William Brenner after a memorandum criticizing him allegedly violated a settlement agreement prohibiting disparagement. The district court had granted summary judgment to the defendants, but the Supreme Court of Wyoming reversed that decision in part and remanded the case for further proceedings. The court ruled that issues regarding qualified immunity and genuine disputes of material fact on the breach of contract claim required further review.

MICHAEL MARKS v. ROSS UNIVERSITY SCHOOL OF VETERINARY MEDICINE, INC., & Others.

Michael Marks sued Ross University School of Veterinary Medicine for unfair business practices and breach of contract after being dismissed from their veterinary program, alleging that the school had failed to provide the accommodations for his learning disabilities he relied upon to enroll. A Superior Court judge granted summary judgment on all claims, ruling that the unfair business practices claim was barred by the statute of limitations and that the breach of contract claim lacked sufficient evidence of a contract, but the Appeals Court reversed the summary judgment on the breach of contract claim.

Gardner v. Norman

In this case, the Utah Supreme Court considered whether evidence of the negotiated charges paid by a plaintiff’s health insurance must be excluded from a negligence claim under the collateral source rule. The Court held that the rule does not apply because neither the plaintiff nor the insurer was obligated to pay the hospital’s gross charges, leading it to vacate the previously awarded special damages and remand for a new trial.
