How to Navigate Mediation Challenges Based on Marriage Length?

Quick answer

Does marriage length change divorce mediation? Yes, explains Florida divorce attorney Bill Leininger, because it drives alimony. He notes a marriage over seventeen years is generally long-term, where lifetime alimony could be granted, while short marriages bring only interim or rehabilitative support. A prenup can lock in a formula, he adds, sparing couples a costly trial.

Law updateNOTE — current law: Florida overhauled alimony after this interview. SB 1416 (effective July 1, 2023) eliminated permanent/lifetime alimony and replaced it with durational alimony capped by marriage length. It also reset the categories: short-term is now under 10 years, moderate-term 10–20, and long-term 20 or more—not Leininger's 17-year threshold. Durational alimony is capped at 50%/60%/75% of the marriage length (short/moderate/long-term), and the amount can't exceed 35% of the spouses' net-income difference. A long Florida marriage no longer supports lifetime alimony.

A short marriage brings only interim or rehabilitative support rather than lifetime alimony.

What alimony formulas do couples use?
